will be made available to consumers on Hudson Valley Voyager and other parteering sites.
Your Deals & Discounts can be anything
from a free glass of wine with dinner to a really great rate
to help get customers during your slow periods. What you offer
and the specifics of that offer are best determined by you
in your mix of marketing initiatives. We give you a way to
connect with potential customers through our database driven
information.
Both of the methods we provide have a couple
of things in common. First, they are categorized within our
7 general categories, (lodging, dining, shopping, outdoors,
arts, heritage & services). Second, they are grouped by
our four regions, (Capital District, Great Estates, Hudson
Highlands & Sleepy Hollow Country). Viewers then have
the ability to select what kind of deal they are looking for
in which of the regions they are going to be visiting.

enforces the rules and conditions of participation in this
Deals & Discounts System to protect the legitimate businesses
and viewers from unscrupulous and illegal activities. We will
make our best efforts to police the companies and offers being
made to insure legitimacy.
- All coupons are subject to removal
at any time for any reason that HV/Net deems appropriate.
If one or more of your offers are removed you will be notified
by e-mail of the decision and the reasons leading to the
decision. Should HV/Net remove an Offer you have the ability
to appeal the decision by providing appropriate documentation
disputing HV/Net's reasons for removal. HV/Net promises
to be as liberal as possible, within the restrictions of
protecting the goals and spirit of its Deals & Discounts
System, in working with you to keep your Offers active and
viable to attract business. If you have not provided an
e-mail address for your company HV/Net is absolved of responsibility
of notifying you of any action taken. HV/Net will not attempt
to contact you via any other communications means.
- All Offers must be for legitimate
products or services that any potential customer may obtain
by simply following the instructions on the Offer or by
appearing at your place of business and surrendering the
Graphic Ad Offer. You may not create products or services
that do not exist and offer them on a Deal or Discount to
draw customers to a fictitious offer to switch the customer
to a higher priced offer, you may not "bait and switch".
Evidence of this activity will permanently bar your company
from participation in any aspect of the Hudson Valley Insider..
- You must honor your Offer presented
in the HV/Net Deals & Discounts System. You are totally
responsible for the text and details that are entered, including
any errors and omissions, that comprise your Offer. If you
have made a mistake in creating your Offer that established
a deal or discount different than you intended, you are
none the less obligated to honor that Offer or provide a
substitute of equal or greater value that is acceptable
to the consumer.
- You may not place restrictions on
your Deal or Discount Offer based upon an potential customer's
race, religion, gender, age, disabilities or lack thereof
or sexual orientation. Deals & Discounts are to be available
to any potential customer with sufficient funds to meet
their side of the transaction. You may, however, provide
information on the Offer dealing with appropriateness of
your product or service to target markets and audiences.
- Your Offer may not contain links
to sexually explicit materials, presentations on intolerance
or bigotry or any other Internet presentation that might
prove offensive to the average viewer. If you do your Deals
& Discounts Offer will be immediately removed and your
company will be permanently barred from any future participation
in Hudson Valley Voyager, and any other program sponsored
or created by HV/Net. There is no appeal or further course
of action you may pursue to regain acceptance.

- You warrant that your Offer, the
text contained and any graphic images utilized do not
libel anyone, infringe anyone's copyright, or otherwise
violate anyone's statutory or common law rights.
- In no event shall Hudson Valley
Network, Inc. be liable for any special, indirect or consequential
damages or any damages whatsoever resulting from loss
of use, data or profits, whether in an action of contract,
negligence or other tortious action, arising out of or
in connection with the use or performance of our software,
documents, provision of or failure to provide services,
or information available.
- You warrant that you have the
right to use any trademark or tradename requested herein
and agree to hold harmless HV/Net from and against any
and all liability and/or claims and will pay all expenses
incurred by HV/Net in the defense thereof arising out
of the publication of any trademark or tradename in accordance
with this agreement. You also warrant that you have the
right to use any name, portrait, picture, or illustration
shown in the copy of your Deals & Discount Offer.
- On each Offer delivered, HV/Net includes
a message encouraging potential customers to report activity
on your part that they find problematic, incorrect or illegitimate;
or to tell us about exemplary conduct or services they find
that make your business even more special.
- Receipt of a SINGLE negative response
will cause a review of your businesses inclusion in the
Deals & Discounts System and may result in the permanent
barring of your company from participation in the Hudson
Valley Insider. You will be contacted via email informing
you of the negative correspondence and you will be requested
to provide appropriate documentation disputing the claim,
in a timely manner. Repeated negative reports from customers
will result in the immediate termination of your account
in the Hudson Valley Insider..
- Good reports will effect the vertical
positioning of your business within the various offers.
- Repeated good reports from customers
will cause your Offers to be featured prominently within
HV/Net's Discount Coupon System.
- The delivery of Offers will be billed
monthly and are due "Net 15 Days" from issue of
invoice. Late payment or non-payment will result in the
immediate removal of all of your Deals & Discounts Offers
from HV/Net's system. To reinstate your Discount Coupon(s)
you will have to provide a deposit in an amount determined
by HV/Net to act as a bank against future charges.
- Delivery charges are calculated by
accumulating the total number of views of your Offer(s)
within a month by using HV/Net's interactive counting programming.
At the end of each month a discount of 20% will be applied
against the total number of views to protect you from erroneous
and excessive downloading, and the balance will be billed.
- At any time you can interactively
come onto this page via your Login and edit, delete or create
Deals & Discounts Offers. As your Offers become active
their activity will be reported to you on the from within
the statistics presentation for your company accessible
from the menu at left. At any time you can see how many
times your Offer(s) have been delivered within a month.
This number is the number you will be billed for.
- By creating your Offer(s) through
our programming you agree to be bound by the Rules of Participation
and charges stated here.
- HV/Net reserves the right to refuse participation
in its Deals & Discount Offers Program to any company
for any reason it deems appropriate.
