Strip Club Expansion Plans
Jan 16th, 2012 | By HV Insider | Category: OP EDI have followed the local resident’s concerns of the expansion plans for the former Blue Moon in Middle Hope to increase it’s square footage and aggressively
grow it’s business. While I am not a proponent or a consumer of the fare that is commonly offered by such establishments, it occurs to me that the following
are the issues:
First, the zoning would seem to be correct for the owner to expand his business regardless of how unsavory some may believe it to be.
Second, many of the adjacent property owners bought their homes knowing full well that they were near a “strip club”.
Third, zoning is not open to preferential adaptation whenever it becomes unpleasant to adjacent property owners.
Fourth, The Town of Newburgh cannot summarily dismiss the application for this business expansion without opening the door to litigation that they cannot win.
While I fully understand the upset of residents affected by this proposed project, I can only ask the question…Why did you buy your home so close to an already existing “strip club or gentlemans club” in the first place? Seems a bit late to argue the point when the facts are seemingly clear as to the legalities.
Even though I understand the distress this may cause, I do not know that the offended parties have a leg to stand on. The old saying would seem to apply..Let the buyer beware.
