Town of Newburgh Police on Tuesday arrested a co-owner of the Elvedge Restaurant after the investigation into a September 11th fight and shooting at the restaurant.
Al-van Brown, 50, of the Town of Newburgh is charged with Assault 1st and Assault 2nd for firing a handgun and injuring two young men. Both are out of  the hospital and are recovering.

Brown is being held for an arraignment in Town Court later Tuesday evening.

On September 11, 2011, the restaurant was hosting a private birthday party for a teenage girl. There was an extensive list of invitees. Several hours into the party dozens of uninvited teens began arriving in cabs and private vehicles. (Word of the party had spread by cell phone and social networking sites.) Some of the uninvited people were let into the building through fire doors by youths inside. A disturbance began inside and the uninvited partycrashers were forced to leave. Several more disputes began near the exit door and two males were shot.

Town of Newburgh Police received several calls reporting shots fired and fights at the Elvedge Restaurant, 101 North Plank Road (formerly Baldini’s Restaurant).  Responding officers saw several groups of youths fleeing the area on foot and several dozen fighting in the parking lot and building. A number of  police units from local agencies responded to assist with the crowd. Two gunshot victims were found.

A 16 year old Newburgh boy and a 23 year old man (address unknown) were wounded in the upper bodies.

A half dozen large windows at the front of the restaurant were then smashed as were the windows of several cars in the lot. Additional damage was done a couple blocks away.

The 16 year old was taken to St. Lukes Hospital and transferred to Westchester Medical Center.  The 23 year old was admitted to St. Francis Hospital in Poughkeepsie.  The gunshot wounds were not life threatening. Both victims were treated and have since been released.
