Guilty Verdict Returned in Town of Newburgh Child Beating Case

An Orange County trial jury deliberated for less than three hours before returning a guilty verdict against Danty Martinez.

Martinez, 29, of Leeds N.Y., was found guilty of Assault 1st degree, Reckless Assault of a Child, and Endangering the Welfare of a Child. The crime took place on August 27, 2011 at the home of the child’s mother in the Town of Newburgh.

He was found to have thrown his 4 month old son Dorian Martinez with such force that the child’s skull was fractured and he suffered permanent neurological injury.

Martinez was arrested by Town of Newburgh police and has been held in the county jail in lieu of $50,000 bail.

When sentenced next month by County Judge Robert Freehill he faces up to 25 years in prison.

The case was prosecuted by Senior Asst DA Michael Milza.
