The man serving 25 year to life for the shooting death of Cosimo DiBrizzi has died in state prison.
Dennis Sweeney died May 2 of cancer while awaiting appeal of his conviction.
Because the case was pending in Appellate Division of State Supreme Court, the high court has granted his assigned counsel’s motion to abate the appeal. A provision that Orange County District Attorney calls, ““ridiculous.”
“Under New York law, which I think is disgraceful, that even though he has been convicted, because he had an appeal pending he will be given the benefit of having the indictment dismissed and essentially die an innocent man in the eyes of the law, but a guilty murderer in the eyes of everybody else,” Phillips added.
Sweeney was charged with DiBrizzi’s death three years after the actual shooting when Sweeney was returned to prison on a previous parole violation and a DNA hit pointed to him.
